These Terms of Service (the “Terms”) govern your access to and use of the services provided by Forbes Lindesay (RollingVersions.com), a British corporation, with its principal place of business at 23 Lannesbury Crescent, St. Neots, United Kingdom (“RollingVersions,” “we,” “our,” or “us”). 1. Scope of Services

RollingVersions provides automated semantic versioning, changelog generation, and deployment management services (the “Service”). Features, functionalities, and updates may vary based on subscription plans. Access to certain features may require a subscription or other fees as described in Section 3.

2. User Eligibility

By using the Service, you represent and warrant that:

1. You are at least 18 years old or the age of majority in your jurisdiction; and
2. You have the authority to enter into a binding agreement, either personally or on behalf of an organization.

3. User Accounts, Subscriptions, and Free Trials

3.1 Creating and Safeguarding Your Account

To access certain features of the Service, you must create an account (“Account”). By creating an Account, you agree to:

• Provide accurate, complete, and current information;
• Keep your Account information up to date;
• Maintain the confidentiality of your password and Account credentials; and
• Notify us immediately at [email protected] if you suspect unauthorized access to your Account.

Your Account is personal to you and may not be transferred to another individual or entity. We reserve the right to suspend or terminate your Account if we determine that you have violated these Terms or engaged in unauthorized use of the Service.

3.2 Subscription Payment

If you purchase a subscription to our paid Services, you agree to:

1. Pay all applicable fees and taxes in accordance with the pricing details in the signed Order Form.
2. Authorize us to store and charge your designated payment method on a recurring basis for subscription renewals, unless canceled.

All fees are exclusive of value-added tax (VAT) and any other applicable taxes and/or duties. Custom invoicing terms will be detailed in the order if applicable.

We reserve the right to adjust pricing at any time with reasonable notice. New pricing will apply to subsequent billing cycles and new contract signatures. Failure to pay fees will result in termination of access to the paid Services.

3.3 Subscription Renewals and Cancellations

All subscriptions automatically renew at the end of the billing period unless canceled prior to the renewal date. To cancel, use the billing portal or contact [email protected]. No refunds will be issued for unused subscription periods unless otherwise required by law. You will retain access to paid Services until the end of the current billing cycle following a cancellation.

3.4 Free Trials

Free trials are available for certain paid Services. Trial periods last for the duration specified at signup (default: 30 days). To avoid charges after the trial, cancel before its expiration. Failure to cancel will result in conversion to a paid subscription, and your payment method will be charged. If you do not continue with the Service, RollingVersions reserves the right to delete or remove data associated with the trial Account.

4. Prohibited Activities

You agree not to:

• Use the Service for unlawful purposes or to violate any applicable laws or regulations;
• Engage in unauthorized scraping, reverse engineering, or exploitation of the Service;
• Introduce malware, viruses, or other harmful elements into the Service; or
• Engage in any conduct that could harm RollingVersions or other users.

5. Intellectual Property

RollingVersions owns all intellectual property rights in the Service, including but not limited to trademarks, logos, software, and documentation. You are granted a limited, revocable license to use the Service solely for its intended purposes and in accordance with these Terms. Unauthorized use, reproduction, or distribution of RollingVersions’ intellectual property is strictly prohibited.

6. Privacy and Data Processing

RollingVersions processes personal data in accordance with applicable data protection laws, including the GDPR. For more details, refer to our Privacy Policy. RollingVersions may use third-party data processors to deliver the Service, including payment processing and analytics.

7. Limitation of Liability

To the maximum extent permitted by law, RollingVersions and its affiliates disclaim all warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

RollingVersions will not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability under these Terms is limited to the amount you paid for the Service in the twelve months preceding the claim.

8. Termination

We may suspend or terminate your access to the Service at our sole discretion, with or without notice, for any breach of these Terms. Upon termination, all rights granted to you under these Terms will immediately cease.

9. Governing Law and Disputes

Any claim relating to the Service, or the use thereof, will be governed by and interpreted in accordance with the laws of the United Kingdom, without reference to its conflict of law principles.

10. Miscellaneous

These Terms constitute the entire terms and conditions between you and RollingVersions relating to the Service and supersede any and all prior written or oral agreements or understandings. Where there is any conflict with these Terms and associated Orders, such Orders shall take precedence.
